These Terms of Service (“Terms”) apply to your use of SaaSy Funnels, a white label of GoHighLevel, operated by The SaaSy Coach Pty Ltd (ABN: 85 675 463 662, “we”, “us” or “our”), registered in Australia.
By accessing or using SaaSy Funnels, you agree to be bound by these Terms, our Privacy Policy, and any applicable fee terms.
If you use SaaSy Funnels on behalf of a business entity, you confirm you have authority to do so and accept these Terms on its behalf.
We may update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.
SaaSy Funnels operates on GoHighLevel (“GHL”) software and may use third-party services (e.g., Twilio, Mailgun, Stripe, Google).
Features may depend on GHL or third-party providers. We are not responsible for interruptions or changes caused by these providers.
Your use is also subject to GHL’s Terms of Service: GoHighLevel Terms.
“Account” means the account you create to use SaaSy Funnels.
“Applicable Law” means all relevant laws and regulations, including Australian Consumer Law.
“Authorised User” means your employees, agents, or contractors authorised to access your Account.
“Customer Data” means data you provide, including personal data of your customers or end users.
“Platform” means SaaSy Funnels, including all proprietary content made available by us.
“Subscription” means your chosen plan tier.
“You” or “your” means the person or entity registering to use SaaSy Funnels.
You must register an Account using a valid email and secure password.
You are responsible for all activity under your Account and keeping credentials secure.
You may add Authorised Users, who are bound by these Terms.
Sharing or misusing credentials is strictly prohibited.
You must provide accurate and up-to-date information and notify us of changes.
You are solely responsible for all activity under your Account.
We retain administrative access to all Accounts for support, auditing, security, updates, and compliance.
You must not obstruct our administrative access. Accounts may be suspended or terminated if access is revoked or obstructed.
You must not access SaaSy Funnels if you are affiliated with a competing all-in-one software platform or GHL white-label agency.
No access for purposes other than genuine business use (e.g., market research, benchmarking, reverse engineering).
We may suspend or terminate Accounts for breach and pursue legal action as needed.
1. You must not:
Modify, copy, or create derivative works from the Platform;
Reverse engineer, sell, rent, or transfer the Platform;
Engage in unlawful, abusive, or fraudulent activity;
Introduce viruses or malicious code;
Share unauthorised features or templates;
Engage in conduct damaging to our reputation or community.
2. We may suspend or terminate Accounts for any breach or abusive behaviour.
Standard data exports (contacts, transactions, etc.) are available and your responsibility.
Proprietary templates and resources are licensed for use within SaaSy Funnels only and are non-transferable.
Ejecting (Transferring Subaccounts):
You may request to transfer your subaccount to another GoHighLevel agency at any time.
No fee will be charged for this service.
Subscription fees already paid are non-refundable.
You are responsible for setting up your account under the new agency; we are not responsible for data loss or setup issues after transfer.
The SaaSy Essentials plan has no minimum term and may be cancelled at any time.
The SaaSy Supported and SaaSy Ultimate plans, which include monthly Done-For-You services, require a minimum 6-month commitment. Early cancellation will result in the remaining balance for the initial term becoming immediately due.
From time to time, we may offer a trial period. Trial terms will be disclosed at the time of offer.
Trials may require valid payment details and convert to paid subscriptions if not cancelled before expiry.
All trial usage is subject to these Terms.
You must cooperate with us to supply the Platform, provide accurate information, and comply with all laws and reasonable directions.
You are responsible for compliance with any third-party terms (e.g., Stripe, Twilio, Google).
You are solely responsible for ensuring your use of SaaSy Funnels is lawful and compliant with all applicable laws and industry standards.
We do not provide legal advice.
The Platform may include features such as SMS, email, and voice calls, which may incur additional charges.
You are responsible for all communications sent using these features and for compliance with relevant laws (e.g., CAN-SPAM Act).
You are solely responsible for any goods or services sold through the Platform, including compliance, customer service, and dispute resolution.
We may update, modify, or discontinue features at any time. Your subscription is not contingent on the availability of any specific feature.
Subscription fees must be paid according to your chosen plan. All fees are non-refundable except as required by law.
Fees may be charged in AUD or USD, and may include GST if required.
Failure to pay may result in suspension or termination of your Account.
Payment processing is via Stripe, and you agree to their terms.
You are responsible for maintaining up-to-date payment details.
All GoHighLevel add-on features (including but not limited to SMS, email, and other third-party services) will be rebilled to you at a rate of 1.2 times the direct cost to cover Stripe and other bank/transaction fees. By using these add-ons, you agree to these rebilling terms and acknowledge that the markup is to cover processing and administrative costs.
All rights in SaaSy Funnels, templates, automations, and content remain with The SaaSy Coach Pty Ltd or its licensors.
You retain ownership of content you upload, but grant us a licence to use it as needed to provide services.
You must not claim ownership of the Platform or its IP.
You are responsible for any customer data you upload and for complying with privacy laws.
We process your data as a data processor and comply with Australian privacy laws. See our Privacy Policy for details.
You must maintain your own privacy policy and obtain necessary consents from your users.
You warrant that all information and data provided is true and accurate, and your use is lawful.
We use reasonable efforts to provide uninterrupted access, but do not guarantee it.
To the maximum extent permitted by law, our liability is limited to the amount paid by you in the month preceding any claim.
We are not liable for indirect, incidental, or consequential damages, or for issues caused by third-party services.
The Platform and all content are provided “as is” without warranties of any kind.
We disclaim all liability for third-party products, services, or integrations.for indirect, incidental, or consequential damages, or for issues caused by third-party services.
You agree to indemnify us against any loss, damage, or claim arising from your breach of these Terms, unlawful conduct, or infringement of third-party rights.
Both parties agree not to use or disclose confidential information except as required to perform obligations under these Terms.
Any disputes must be raised in writing within 30 days of the event. If not resolved within 14 days, either party may refer the matter to mediation in Australia.
You must be 18 or over to access the Platform. If under 18, you must have parental/guardian consent.
These Terms apply from the date you register and continue while your subscription is active.
You may cancel your subscription at any time. Access continues until the end of the current billing period. Fees already paid are non-refundable.
We may suspend or terminate your account for breach or unlawful conduct.
Upon termination, your account and data may be permanently deleted.
We provide technical support related to the Platform. Support does not include third-party integrations or strategic advice unless agreed separately.
Community features may be provided. You must behave respectfully and professionally. We may revoke access for inappropriate conduct.
We are not responsible for delays or failures caused by events beyond our reasonable control.
Notices must be in writing and delivered to the contact details provided.
These Terms are governed by the laws of Western Australia, and you submit to its courts’ jurisdiction.
If any provision is invalid, it will be replaced with a valid provision that reflects the parties’ intent; the rest of the Terms remain in effect.
These Terms constitute the entire agreement between you and us regarding SaaSy Funnels.
